Indiana's AG urged to appeal abortion ruling

A federal judge has blocked a law in IN that forces women to undergo an ultrasound at least 18 hours before having an abortion.

In her decision, Judge Pratt says, quote, "The burdens it creates on women ... which are significant even if not overwhelming, dramatically outweigh the benefits, making the burdens undue and the new ultrasound law likely unconstitutional".

A federal judge has blocked an IN law that would have required pregnant women to undergo an ultrasound at least 18 hours prior to an abortion.

"Judge Sachs was clear in his memo that these laws are unconstitutional and only seek to block access to safe, legal abortion", Planned Parenthood said in a statement Wednesday.

A preliminary injunction has been granted against the provision.

Betty Cockrum calls Friday's decision "an incredibly strong ruling" that protects IN women's constitutional right to an abortion.

Planned Parenthood sued the commissioner of the Indiana State Department of Health as well as several county prosecutors past year, specifically targeting the ultrasound mandate in its complaint. Last year's legislation required the ultrasound at least 18 hours before the abortion, meaning - as Planned Parenthood argued - that women would have to make two separate, often lengthy, trips to one of the few clinics that perform abortions. It found that 99 percent women proceeded with an abortion after not viewing the ultrasound, compared with 98.4 percent who did view the ultrasound. That clause adds an 18-hour waiting period to an existing requirement that a woman have an ultrasound before she can have an abortion.

Planned Parenthood said in its lawsuit that under the state's earlier measure the group performed ultrasounds on women immediately prior to their abortions.

CEO of Planned Parenthood of IN and Kentucky, Betty Cockrum, says the requirement flew IN the face of evidence-based medical practices. They have 30 days to do so.

A pro-life leader in IN, disappointed by a ruling against the state's ultrasound law, says the judge issuing the ruling failed to recognize a legitimate alternative to what the judge considers a problem with the law.
